While providing free online access to The Color Code Personality Profile, TheColorCode.com has strict rules against SPAM, and communicates to customers the importance of clean, verified opt-in lists for bulk email communication.

TheColorCode.com does not condone the sending of unsolicited bulk email or junk email (SPAM) as a business practice. If a TheColorCode.com customer is found in violation of our License Agreement, Anti-Spam Policy, or Terms of Use, they should be reported to stopspam@thecolorcode.com immediately.

Defined: Internet SPAM is one or more unsolicited messages, sent or posted as part of a larger collection of messages, all having substantially identical content.

This includes: Unsolicited bulk email that has not been VERIFIED by the receiver. Unless it was the obvious and clear intent of the receiver to participate, as a receiver, in bulk messaging (of a particular type, category or class) initiated by a given sender, then any messages sent from that sender to that receiver are, by definition, unsolicited and NOT verified. Customers of TheColorCode.com are urged to verify their data.

An email sent to a recipient who would NOT have a reasonable expectation of receiving email from the sender. Note: this applies to bulk messages and not users of the site sending single, personal messages.

Any email advertising illicit or illegal activities, or infringement or misappropriation of intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, and patents held by individuals, corporations, or other entities.

Third Party Lists

Third party lists (TPLs) are defined as lists of email addresses transferred to the sender from a third party. Use of TPLs within our system is strictly controlled to ensure that messages that constitute spam (as defined above) are not sent. It is the opinion of TheColorCode.com that an email address is the property of the addressee and that they have the right to deny use of their property to any party. Thus only re-verified TPLs can be used, where the original user of the list does the re-verification.

Any violation of TheColorCode.com' TPL policy will be subject to disciplinary action, and possibly termination of an account.

Verified Opt-In Emails

Often times, companies buy lists labeled as "opt-in." TheColorCode.com policy is that a customer must directly verify every address in an "opt-in" list before distributing an email to that list of potential recipients. In other words, the company/customer MUST contact individuals before sending communication and have the individual confirm and accept use of their email address by the sender. This ensures the email recipient has directly approved - hence "verified" email correspondence with the company.

In addition, TheColorCode.com expects customers to maintain records of verification of each individual contact. If you do not believe that you subscribed with this customer or to this list, please contact TheColorCode.com and we will request a record of confirmation to verify legitimacy of records.

To unsubscribe from an UNSOLICITED email sent by an individual using the TheColorCode.com mail-to forms, TheColorCode.com site and services provide email recipients the opportunity to manage their subscription and remove themselves from the customers' contact list, thus eliminating future communications. To remove your name from a list, select the "Unsubscribe" option that is included on the bottom of every TheColorCode.com email. TheColorCode.com will mark your contact information as "unsubscribed" and notify the company (our customer) from whom you received the email.

Individuals receiving an email from a TheColorCode.com customer may also choose to contact the company directly to request their removal.

Reporting Spam

TheColorCode.com is concerned with individual's privacy, and wants to know if a customer is spamming and in violation of our Acceptable Use and Anti-Spam policies. If you find a customer is in violation, please notify us by the following mechanism:

  • Forward the entire message to stopspam@thecolorcode.com. Please be sure to include the entire header portion of the original message.


  • What does TheColorCode.com do if a customer is Spamming?

    TheColorCode.com expects that customers will fully comply with our Terms of Use Policies and Anti-Spam Policy concerning the privacy of on-line communication and Spam. If TheColorCode.com discovers that a customer is in a violation, this shall entitle TheColorCode.com to:
    • Terminate any service agreement in place.
    • Remove or block violating customers' access to site mail-to forms upon receipt of a proper notice of Spam.
    • Hold the right to take legal action against a customer depending on the level of severity of the situation.


    In addition, offending messages in the TheColorCode.com mail-to system will be replaced with a message indicating that it was removed due to policy violations.
